The Texas Hemp Constitutional Alliance just filed an amicus brief in THBC's lawsuit challenging the new DSHS hemp rules.
On this episode we explain what an amicus brief is and how it helps the THBC lawsuit. In the brief, THCA makes three main points as rebuttals to the state's latest arguments:
1) The legislature did in fact consider THC acid (THCa) when writing the statues. "Acids" are explicitly included in the statute's definition of hemp.
2) DSHS can't close the compliance pathways created by the statutes.
3) The potential changes to federal hemp laws are not relevant to state agency rule making.
We breakdown our understanding of THCA's amicus brief arguments and discuss how we see things unfolding from here.
