(3:33) Three Layers of Kedusha in Eretz Yisrael
(6:28) Bikkurim as a Personal Offering for All Israel

AI-Generated Summary (AI can be inaccurate. Check important information):

The central question of this shiur addresses why the Rambam rules that bringing Bikkurim from the east side of the Jordan River is only a rabbinic obligation, despite the broad national borders of Eretz Yisrael. The speaker suggests that the Rambam identifies three distinct levels of sanctity in the land: agricultural sanctity, national-political status, and Kedushas HaShechinah, which emanates from the Holy of Holies. Because Bikkurim are categorized in the Mishnah alongside the Omer and Shtei HaLechem, they depend specifically on this third level of sanctity, which is restricted to the land west of the Jordan. Consequently, the mitzvah of Bikkurim offers every individual Jew a unique opportunity to connect produce grown within the presence of the Shechinah back to its source in the Beis HaMikdash.

1. The scope of Bikkurim โ€” While the Mishnah in Bikkurim records a dispute regarding whether produce from the east side of the Jordan (Ever Hayarden) is eligible for Bikkurim, the Rambam rules that it is only a mi-derabbanan (rabbinic) obligation.
2. Three levels of Kedusha โ€” The sanctity of Eretz Yisrael is comprised of three distinct facets: kedushas karka (sanctity of the soil), shem Eretz Yisrael (national/political status), and kedushas HaShechinah (the presence of the Divine).
3. National vs. Agricultural borders โ€” Certain mitzvos like Egla Arufa and Semicha depend on the broad national borders of Israel, whereas Bikkurim is uniquely tied to the specific area where the Shechinah rests.
4. Concentric circles of holiness โ€” The Mishnah in Kelim describes ten levels of sanctity emanating from the Kodesh Hakodashim (Holy of Holies), identifying Eretz Yisrael as the outermost circle of this Divine radiation.
5. The uniqueness of the West Bank โ€” Following the view of the Ramban and others, the Rambam implies that the kedushas HaShechinahโ€”the direct resting of the Divine presenceโ€”is primarily manifest on the west side of the Jordan River.
6. Bikkurim as a personal connection โ€” Unlike the Omer and Shtei HaLechem which are communal offerings, Bikkurim allows every individual Jew to personally bring produce from the "land of the Shechinah" back to its source in the Beis HaMikdash.

In this week's ืคืจืฉื” *parsha*,

ืคืจืฉืช ื›ื™ ืชื‘ื•ื *Parshat Ki Savo*,

we read about the ื‘ื™ื›ื•ืจื™ื *Bikkurim* and there is a fascinating discussion about ื‘ื™ื›ื•ืจื™ื

*Bikkurim* that can help us appreciate one of the facets of what is so

special about ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael*.

From where does one bring ื‘ื™ื›ื•ืจื™ื *Bikkurim*?

So the ืžืฉื ื” *Mishnah* in ื›ืœื™ื *Kelim* says that one of the aspects of

ืงื“ื•ืฉืช ืืจืฅ ื™ืฉืจืืœ *Kedushas Eretz Yisrael*,

which makes it more ืงื“ื•ืฉ *kadosh* than the rest of the world,

is that we only bring ื‘ื™ื›ื•ืจื™ื *Bikkurim* from ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael*.

From which part of ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael* do we bring ื‘ื™ื›ื•ืจื™ื *Bikkurim*?

ืจื‘ื™ ื™ื•ืกื™ ื”ื’ืœื™ืœื™ *Rabbi Yosei HaGlili* says in the ืžืฉื ื” *Mishnah* in ื‘ื™ื›ื•ืจื™ื *Bikkurim*

that we do not bring ื‘ื™ื›ื•ืจื™ื *Bikkurim* from ืขื‘ืจ ื”ื™ืจื“ืŸ *Ever Hayarden* because it's

not called the ืืจืฅ ื–ื‘ืช ื—ืœื‘ ื•ื“ื‘ืฉ *Eretz Zavat Chalav U'dvash*.

We only bring from the west side of the ื™ืจื“ืŸ *Yarden* because that is

the ืืจืฅ ื–ื‘ืช ื—ืœื‘ ื•ื“ื‘ืฉ *Eretz Zavat Chalav U'dvash* that is described in this

week's ืคืจืฉื” *parsha*.

However,

the ืชื ื ืงืžื *Tanna Kamma* there disagrees.

The ืจืžื‘"ื *Rambam* in ืคื™ืจื•ืฉ ื”ืžืฉื ื™ื•ืช *Perush Hamishnayos* there in ื‘ื™ื›ื•ืจื™ื *Bikkurim* says that

the ื”ืœื›ื” *halacha* is not like ืจื‘ื™ ื™ื•ืกื™ ื”ื’ืœื™ืœื™ *Rabbi Yosei HaGlili* but rather

like the ืชื ื ืงืžื *Tanna Kamma*.

Therefore,

we would expect that the ืจืžื‘"ื *Rambam* in ืžืฉื ื” ืชื•ืจื” *Mishneh Torah* would ืคืกืงืŸ

*pasken* that we bring ื‘ื™ื›ื•ืจื™ื *Bikkurim* from ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael* including ืขื‘ืจ ื”ื™ืจื“ืŸ

*Ever Hayarden*,

including the east side of the Jordan River.

However,

the ืจืžื‘"ื *Rambam* in ื”ืœื›ื•ืช ื‘ื™ื›ื•ืจื™ื *Hilchos Bikkurim* ืคืจืง ื‘ *Perek Bais* ื”ืœื›ื” ื

*Halacha Aleph* ืคืกืงืŸ *paskens* that we only bring ื‘ื™ื›ื•ืจื™ื *Bikkurim* ืžื“ืื•ืจื™ื™ืชื *mi-d'Oraisa* from the

west side of the ื™ืจื“ืŸ *Yarden* and from the east side of the ื™ืจื“ืŸ

*Yarden*,

from ืืจืฅ ืกื™ื—ื•ืŸ ื•ืขื•ื’ *Eretz Sichon Ve'Og*,

ื‘ื™ื›ื•ืจื™ื *Bikkurim* is only a ื—ื™ื•ื‘ ืžื“ืจื‘ื ืŸ *chiyuv mi-derabbanan*.

The ื›ืกืฃ ืžืฉื ื” *Kesef Mishneh* there explains in the name of the ืžื”ืจื™"ืง *Maharik*

that the ืจืžื‘"ื *Rambam* learns the ืžื—ืœื•ืงืช *machlokes* between the ืชื ื ืงืžื *Tanna Kamma*

and ืจื‘ื™ ื™ื•ืกื™ ื”ื’ืœื™ืœื™ *Rabbi Yosei HaGlili* is only a ืžื—ืœื•ืงืช ืžื“ืจื‘ื ืŸ *machlokes mi-derabbanan*.

But really ืžื“ืื•ืจื™ื™ืชื *mi-d'Oraisa* everybody agrees that ื‘ื™ื›ื•ืจื™ื *Bikkurim* are not brought from the

east side of the Jordan River.

And the question is why not?

The question is why not?

After all,

the ืจืžื‘"ื *Rambam* holds in a few places,

including when it comes to ืขื’ืœื” ืขืจื•ืคื” *Egla Arufa* and ืกืžื™ื›ื” *semicha*,

that the ืฉื ืืจืฅ ื™ืฉืจืืœ *shem Eretz Yisrael*,

the borders of ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael* for various non-agricultural ืžืฆื•ื•ืช *mitzvos*,

are broad and include the entire area conquered by the ืขื•ืœื™ ืžืฆืจื™ื *Olim Mitzrayim*,

the entire area conquered from the time of ืžืฉื” ืจื‘ื ื• *Moshe Rabbeinu* and ื™ื”ื•ืฉืข

ื‘ืŸ ื ื•ืŸ *Yehoshua Bin Nun* up through ื“ื•ื“ ื”ืžืœืš *David HaMelech* and ืฉืœืžื” ื”ืžืœืš

*Shlomo HaMelech*.

That entire area was given the title of ืฉื ืืจืฅ ื™ืฉืจืืœ *shem Eretz Yisrael*,

was given the title of the borders of ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael*,

and the ื”ืœื›ื•ืช *halachos* of ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael* that are not agricultural in

nature,

meaning not the ื”ืœื›ื•ืช *halachos* of ืชืจื•ืžื•ืช ื•ืžืขืฉืจื•ืช *terumos u'ma'asros*,

but rather things like ืขื’ืœื” ืขืจื•ืคื” *Egla Arufa*,

things like ืกืžื™ื›ื” *semicha*,

they apply in the broader area of ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael*.

So ื‘ื™ื›ื•ืจื™ื *Bikkurim*,

even though ื‘ื™ื›ื•ืจื™ื *Bikkurim* grow out of the ground,

but it's not a ืžืฆื•ื•ื” ืชืœื•ื™ื” ื‘ืืจืฅ *mitzvah teluyah ba'aretz* as ืชื•ืกืคื•ืช *Tosafos* says

in ื‘ื‘ื ื‘ืชืจื *Bava Basra*.

It's not a ืžืฆื•ื•ื” ืชืœื•ื™ื” ื‘ืืจืฅ *mitzvah teluyah ba'aretz*.

It's rather a ื”ืœื›ื” *halacha* that one brings produce to the ื‘ื™ืช ื”ืžืงื“ืฉ *Beis

HaMikdash*.

Why would the ืจืžื‘"ื *Rambam* ืคืกืงืŸ *pasken* that it does not apply in ืขื‘ืจ

ื”ื™ืจื“ืŸ *Ever Hayarden*?

We would expect that if the broader non-agricultural borders of ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael*

include ืขื‘ืจ ื”ื™ืจื“ืŸ *Ever Hayarden*,

we would expect that ื‘ื™ื›ื•ืจื™ื *Bikkurim* should be brought even from ืขื‘ืจ ื”ื™ืจื“ืŸ *Ever

Hayarden*.

So why does the ืจืžื‘"ื *Rambam* learn the ืžืฉื ื” *Mishnah* in ื‘ื™ื›ื•ืจื™ื *Bikkurim* such

that all ืชื ืื™ื *Tanna'im* agree that we don't ืžื“ืื•ืจื™ื™ืชื *mi-d'Oraisa* bring ื‘ื™ื›ื•ืจื™ื *Bikkurim* from

ืขื‘ืจ ื”ื™ืจื“ืŸ *Ever Hayarden*?

So it could be that the ืจืžื‘"ื *Rambam* learns from the ืžืฉื ื” *Mishnah* in

ื›ืœื™ื *Kelim*,

the ืžืฉื ื” *Mishnah* in ื›ืœื™ื *Kelim* that we referenced before,

which says that ื‘ื™ื›ื•ืจื™ื *Bikkurim* together with ืขื•ืžืจ *Omer* and ืฉืชื™ ื”ืœื—ื *Shtei HaLechem*

are only brought from ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael*.

And that's an expression of what makes ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael* ืงื“ื•ืฉ *kadosh* compared

to the rest of the world.

Perhaps the ืจืžื‘"ื *Rambam* learned from that ืžืฉื ื” *Mishnah* something crucial about what makes

ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael* so special.

Until now,

we've mentioned that there is a ืงื“ื•ืฉื” *kedusha* to the ground of ืืจืฅ ื™ืฉืจืืœ

*Eretz Yisrael*,

the ืงื“ื•ืฉืช ืงืจืงืข *kedushas karka* of ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael* that makes ืืจืฅ ื™ืฉืจืืœ

*Eretz Yisrael* ืงื“ื•ืฉ *kadosh* for ืชืจื•ืžื•ืช ื•ืžืขืฉืจื•ืช *terumos u'ma'asros* and ืžืฆื•ื•ืช ื”ืชืœื•ื™ื•ืช ื‘ืืจืฅ *mitzvos

ha-teluyos ba'aretz*.

We've mentioned that ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael* has a ืฉื ืืจืฅ ื™ืฉืจืืœ *shem Eretz

Yisrael* as a national political entity that is important for ืžืฆื•ื•ืช *mitzvos* like ืขื’ืœื”

ืขืจื•ืคื” *Egla Arufa* and ืกืžื™ื›ื” *semicha*.

But there's a third aspect.

That ืžืฉื ื” *Mishnah* in ื›ืœื™ื *Kelim* is actually part of a set of ืžืฉื ื™ื•ืช

*mishnayos* which is describing the concentric circles of ืงื“ื•ืฉื” *kedusha* that emanate out from

the ืงื•ื“ืฉ ื”ืงื•ื“ืฉื™ื *Kodesh Hakodashim*.

The ืžืฉื ื™ื•ืช *mishnayos* in ื›ืœื™ื *Kelim* go through ten levels of ืงื“ื•ืฉื” *kedusha* that

start from ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael* going inward to ื™ืจื•ืฉืœื™ื *Yerushalayim*,

and within ื™ืจื•ืฉืœื™ื *Yerushalayim* to the ื”ืจ ื”ื‘ื™ืช *Har HaBayis*,

and within the ื”ืจ ื”ื‘ื™ืช *Har HaBayis* to different levels of ืงื“ื•ืฉื” *kedusha* as

one goes further and further and closer and closer to the ืžืงื•ื *makom* of

the ืงื•ื“ืฉ ื”ืงื•ื“ืฉื™ื *Kodesh Hakodashim*.

The ืžืงื•ื *makom* of the ืงื•ื“ืฉ ื”ืงื•ื“ืฉื™ื *Kodesh Hakodashim* is the center point of

what the ืจืžื‘"ื *Rambam* calls elsewhere the ืฉื›ื™ื ื” *Shechinah*,

the ืงื“ื•ืฉืช ื”ืฉื›ื™ื ื” *kedushas HaShechinah* in this world is centered in the ืงื•ื“ืฉ ื”ืงื•ื“ืฉื™ื

*Kodesh Hakodashim*.

That ืงื“ื•ืฉืช ื”ืฉื›ื™ื ื” *kedushas HaShechinah* emanates outward in levels with more,

with levels of ืงื•ืœื *kula* as you go out from the ืงื•ื“ืฉ ื”ืงื•ื“ืฉื™ื *Kodesh

Hakodashim*.

It goes out in levels to the borders of ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael*.

Beyond the borders of ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael*,

there are no more ื”ืœื›ื•ืช *halachos* that depend on ืงื“ื•ืฉืช ื”ืฉื›ื™ื ื” *kedushas HaShechinah*.

But there are three ื”ืœื›ื•ืช *halachos* listed in that ืžืฉื ื” *Mishnah* in ื›ืœื™ื *Kelim*

that are expressions of the ืงื“ื•ืฉืช ื”ืฉื›ื™ื ื” *kedushas HaShechinah* which is ืฉื•ืจื” *shoreh* in

ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael*.

That ืงื“ื•ืฉืช ื”ืฉื›ื™ื ื” *kedushas HaShechinah* is what governs the ื”ืœื›ื•ืช *halachos* of ืขื•ืžืจ *Omer*,

ืฉืชื™ ื”ืœื—ื *Shtei HaLechem*.

and ื‘ื™ื›ื•ืจื™ื *Bikkurim*.

The ืขื•ืžืจ *Omer* and ืฉืชื™ ื”ืœื—ื *Shtei Halechem* can only be brought from grain

that grew in the land of ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael* which is ืงื“ื•ืฉ *kadosh*

ื‘ืงื“ื•ืฉืช ื”ืฉื›ื™ื ื” *bikedushas HaShechina* and the ื‘ื™ื›ื•ืจื™ื *Bikkurim*,

the ื‘ื™ื›ื•ืจื™ื *Bikkurim* can only be brought from the part of ืืจืฅ ื™ืฉืจืืœ *Eretz

Yisrael* which is ืงื“ื•ืฉ *kadosh* ื‘ืงื“ื•ืฉืช ื”ืฉื›ื™ื ื” *bikedushas HaShechina*.

And therefore that could explain the ืจืžื‘"ื *Rambam*,

that the ืจืžื‘"ื *Rambam* says ื‘ื™ื›ื•ืจื™ื *Bikkurim* according to all the ืชื ืื™ื *Tannaim*,

ื‘ื™ื›ื•ืจื™ื *Bikkurim* can only be brought from the land which has ืงื“ื•ืฉืช ื”ืฉื›ื™ื ื” *Kedushas

HaShechina*.

And that ืฉื›ื™ื ื” *Shechina* perhaps the ืจืžื‘"ื *Rambam* holds as other ืจืืฉื•ื ื™ื *Rishonim* hold

like the ืจืžื‘"ืŸ *Ramban* and the ืจ"ืŸ *Ran* and others hold that the ืงื“ื•ืฉืช

ื”ืฉื›ื™ื ื” *Kedushas HaShechina* is only on the west side of the Jordan River.

What we learn from here perhaps something astounding,

that first of all that there are three elements of ืงื“ื•ืฉืช ืืจืฅ ื™ืฉืจืืœ *Kedushas

Eretz Yisrael*,

there's ืงื“ื•ืฉืช ื”ืงืจืงืข *Kedushas Hakarka*,

there's the ืฉื ื™ืฉืจืืœ *Shem Yisrael*,

the national political sovereignty,

and there is also ืงื“ื•ืฉืช ื”ืฉื›ื™ื ื” *Kedushas HaShechina*,

the place which is the outermost expression of the ืฉื›ื™ื ื” *Shechina* which resides in

the ืžืงื“ืฉ *Mikdash*,

in the ืงื•ื“ืฉ ื”ืงื“ืฉื™ื *Kodesh HaKodashim*.

But we also see from here something amazing about ื‘ื™ื›ื•ืจื™ื *Bikkurim*.

Because ืขื•ืžืจ *Omer* and ืฉืชื™ ื”ืœื—ื *Shtei Halechem* are national ืžืฆื•ื•ืช *mitzvos*.

ืขื•ืžืจ *Omer* and ืฉืชื™ ื”ืœื—ื *Shtei Halechem* are one ืงืจื‘ืŸ *korban* brought on behalf

of all ื›ืœืœ ื™ืฉืจืืœ *Klal Yisrael*.

So the ื›ื”ื ื™ื *kohanim* who are ืขื•ืกืง *osek* in ืขื•ืžืจ *Omer* and ืฉืชื™ ื”ืœื—ื

*Shtei Halechem*,

they have the opportunity to bring that ืงืจื‘ืŸ *korban* and that ืงืจื‘ืŸ *korban* is

something which you take grain which grows in a place which is related to

ืงื“ื•ืฉืช ื”ืฉื›ื™ื ื” *Kedushas HaShechina*,

a place which is as it were a recipient if you will of the

ืงื“ื•ืฉืช ื”ืฉื›ื™ื ื” *Kedushas HaShechina* and brings it to ื™ืจื•ืฉืœื™ื *Yerushalayim*.

But the ื‘ื™ื›ื•ืจื™ื *Bikkurim* is for all ื›ืœืœ ื™ืฉืจืืœ *Klal Yisrael*.

This week's ืคืจืฉื” *Parsha* tells us that there's a ืงืจื‘ืŸ *korban*,

a type of ืงืจื‘ืŸ *korban*,

a ื‘ื™ื›ื•ืจื™ื *Bikkurim* which is not exactly a ืงืจื‘ืŸ *korban*,

it's a ื”ื‘ืื” *hava'ah*.

There's a type of ื”ื‘ืื” *hava'ah*,

a type of offering that every single Jew could do.

Every single Jew has the opportunity to take something and appreciate that this item

is growing in the place of the ืฉื›ื™ื ื” *Shechina* and he wants to take

that and bring it with him to the source of that ืงื“ื•ืฉืช ื”ืฉื›ื™ื ื” *Kedushas

HaShechina* to the ื‘ื™ืช ื”ืžืงื“ืฉ *Beis Hamikdash* to bring it ืœืคื ื™ ื”ืฉื *lifnei HaShem*.

It's an astounding ืžืฆื•ื” *mitzvah* and one which helps us appreciate what a special

place we have in ืืจืฅ ื™ืฉืจืืœ *Eretz Yisrael* and one that ื‘ืขื–ืจืช ื”ืฉื *beโ€™ezras

HaShem* we all hope to be able to be ืžืงื™ื™ื *mekayeim* ื‘ืคื•ืขืœ *bepoal* ื‘ืžื”ืจื”

ื‘ื™ืžื™ื ื• *bimheira beyameinu*.
