Welcome to Carver's regulatory updates podcast for the week of September 13, 2026.

Starting with the United States, the Texas Commission on Environmental Quality, or TCEQ, approved fines totaling $1,450,788 against 52 entities for environmental violations. These penalties, exceeding 1.3 million dollars, accompany considerations of multiple permit applications and amendments. The commission also reviewed annual Watermaster cost assessments for fiscal year 2027. Violating entities are required to pay the assessed administrative penalties and comply with air quality and water regulations as per agreed and default orders. Written comments for emergency order considerations were due by September 7, 2026.

In the United States again, the Securities and Exchange Commission, or S-E-C, issued Release Number 34-106287 and IA-6995 on September 8, 2026, concerning Independent Financial Group, L-L-C. The S-E-C found that Independent Financial Group willfully violated Section 13(f)(1) of the Exchange Act and Rule 13f-1 by failing to file quarterly Forms 13F from December 31, 2021, through December 31, 2025. Sanctions include a cease-and-desist order, censure, and a civil penalty of $500,000. The firm must pay the penalty within 30 days and comply with future Form 13F filing obligations.

The United States Food and Drug Administration, or FDA, issued guidance for immediate implementation on temporary policies for compounding certain starter parenteral nutrition drug products for neonates. This guidance applies to outsourcing facilities, State-licensed pharmacies, and Federal facilities not registered as outsourcing facilities. Compliance with the FDA's temporary policies and enforcement priorities is required.

Turning to Canada, the Director has suspended the registration of Dax Sukhraj as Ultimate Designated Person and acting Chief Compliance Officer of Argosy Securities Inc. The Director approved the reinstatement of Ilia Katerli as Chief Compliance Officer and imposed additional terms and conditions on Argosy's registration as an investment dealer.

In Australia, the Australian Prudential Regulation Authority, or A-P-R-A, released revised draft reporting standards and supporting materials for the Government’s Retirement Reporting Framework. The revisions streamline data requirements, refine methodologies and definitions, and introduce a new reporting practice guide. The consultation period has been extended by one month, with submissions due by October 9, 2026. Data collection is expected to begin in late 2027.

In the European Union, the European Central Bank Governing Council raised the three key interest rates by 25 basis points effective September 16, 2026. The ECB emphasized a data-dependent approach without pre-committing to a rate path.

Also in the European Union, a presentation and exchange of views took place regarding a proposal for a regulation repealing previous directives and amending several EU regulations related to public procurement.

Additionally, the European Union issued notice of a meeting and provisional agenda for the Foreign Relations Counsellors/Sanctions Formation meeting scheduled on September 16, 2026. The meeting will include updates on sanctions implementation and enforcement, presentations on circumvention trends, and humanitarian exemptions.

In India, Shri Shirish Chandra Murmu, Deputy Governor of the Reserve Bank of India, delivered a keynote address at the Global Fintech Fest 2026 in Mumbai on September 11, 2026. The speech outlined evolving regulatory expectations for digital payments, digital lending, artificial intelligence, and quantum computing. Emphasis was placed on accountability, operational and cyber resilience, fraud prevention, and customer protection. Key requirements include ensuring operational resilience with 24 by 7 by 365 availability, strengthening cyber resilience using measures such as exclusive '.bank.in' domains, and collaboration across ecosystem participants to prevent and detect fraud. The policy impact includes adopting frameworks for responsible AI and quantum computing readiness.
